Terms and conditions - Park & Bike The Hague

Article 1. Definitions
Park & Bike The Hague: GA Den Haag Foundation, established in The Hague under Chamber of Commerce number 74335766;
Parking: The layout that includes the parking lots;
Payment: The payment of the rent and parking fee through the website using payment functionality provided by iDeal or credit card by the tenant;
Usage: Reserving a parking space and a bicycle and also putting them into use;
User: The natural or legal person who enters into the lease as the lessee;
Lease Agreement: The agreement whereby the lessee rents a parking space and a bicycle from Park & Bike The Hague;
Rate schedule: List containing the tariffs to be paid by the lessee for the use of the services and/or products of Park & Bike Den Haag.

Article 2. Applicability
These general terms and conditions apply to all user agreements with the renters. Both via computer and mobile devices or any other software application, as available from partners or an app, as well as to all agreements of rental and lease of the parking space and a bicycle concluded between the lessor and the lessee through the website.

Article 2. Registration
1) Park & Bike Den Haag reserves the right to refuse the registration of a potential tenant, if there is reason to believe that the applicant will not behave in accordance with the agreement.
2) By using the website and accepting the offer, the hirer binds himself to these general conditions. The hirer must provide all the correct information that Park and Bike Den Haag requires to create an account. This includes first and last name, home address, email address and mobile phone number. The hirer is responsible for the authenticity of these data.

Article 4. Means of Access
1) To enable use, the renter must make a reservation. The renter registers

2) The renter reserves a parking space and a bicycle via the website. Park and Bike The Hague has the right not to accept the reservation in case there are no parking spaces and/or bicycles available or in all other cases a reservation cannot be accepted.

Article 5. Rental Agreement and Payment
1) Renters can rent parking spaces and bicycles from Park en Bike Den Haag by making reservations through the website. The rental agreement for the use of a parking space and a bicycle comes into effect when the lessee starts the rental through the website. The reservation is only effected when the hirer has fulfilled the payment.
2) When reserving the parking space and bicycle, the hirer is obliged to pay the agreed rates for use. The rental fee and parking fee and also all other amounts due in respect of the rental agreement.
3) The renter has the option to extend a reservation if parking and bicycle availability is positive. If a reservation is extended, the renter will be liable for additional rental and parking fees.

Article 6. Rental period
1) The rental period starts when the lessee reserves the parking space and bicycle and enters into a rental agreement for a certain agreed period. The period ends on the date specified by the lessee when reserving a parking space and a bicycle. The hirer pays for the specified period of rental of a parking space and a bicycle.
2) If the rental agreement cannot be terminated in any way, the tenant must contact Park & Bike Den Haag immediately.

Article 7. Obligations of the Tenant and Landlord
1) Landlord: Park & Bike Den Haag will provide the tenant with a parking space and a bicycle that is in good and safe condition, meets all legal requirements and is equipped with double locks to protect the bicycle against theft.
2) The landlord has the right to indicate to the tenant where the bicycle should not be used or stored.
3) Hirer: The hirer is expected to inspect the bicycle for any damage and/or other observable defects before it is put into use.
4) It is not allowed to transport other persons on the bicycle and use the parking lot than only the lessee.
5) The lessee shall use a bicycle as it should be used, according to the applicable instructions of government personnel. When storing, the lessee shall lock the bicycle with both locks of which it is provided.
6) The Lessee shall not make any changes to the bicycle or make any repairs.
7) The hirer is obliged to return the bike to the Park & Bike Duindigt return point. The bicycle must then be locked with both locks.
8) The bicycle may only be used within a radius of 50 kilometers from the Park & Bike Den Haag location. The use of the bicycle outside the Netherlands is not allowed.
9) If the lessee does not fulfill the obligations in accordance with the rental agreement and the general conditions, Park & Bike Den Haag has the right to terminate the lessee's current and future use of the bicycle with immediate effect.
10) If the landlord or the tenant fails to fulfill the obligations of the rental agreement, the other party is allowed to suspend or terminate the rental agreement.

Article 8. Damage, repair, loss or theft
1) Repairs to the bicycle are the responsibility of Park & Bike Den Haag, except if the damage is the result of the tenant's behavior. Park & Bike Den Haag reserves the right to charge the renter for any repair costs resulting from not careful use of the bicycle.
2) The hirer is not allowed to carry out repairs on the bicycle or have them carried out by anyone other than Park & Bike Den Haag, unless Park & Bike Den Haag gives permission.
3) In the event that defects are found or in the event of theft and/or loss, these must be reported immediately to Park & Bike The Hague. This can be done by e-mail at info@fietsverhuurzuidholland.nl or during office hours by telephone at +31(0)70 355 40 60.
4) During the rental period, the renter is liable for damage due to negligent use, loss or theft and likewise all costs associated with its use, such as storage or improper storage of a bicycle.
5) In case of theft, the renter must request the details of the bicycle from the rental company, report the theft to the police, submit a duplicate copy of the police report in person or digitally (info@fietsverhuurzuidholland.nl) and, if available, the spare key to Park & Bike Den Haag.
6) If the bike key is present, you will pay an excess of € 100,00 per regular bike, € 200,00 per cargo bike, € 250,00 per electric cargo bike, € 150,00 per electric bike or € 250,00 per electric scooter. If you cannot provide the bicycle key, you will pay the value of the bicycle, cargo bike or scooter.
7) You are insured for damage to the bicycle. This will be repaired as soon as possible.

Article 9. Liability
1) Park & Bike The Hague cannot be held liable to compensate any damage, which is a direct or indirect consequence of:
o Damage resulting from any intentional or negligent acts of the tenant.
o Damage resulting from defects that cannot be attributed to Haagsche Stadsfiets.
o Damage when the renter has not used the shared bicycle correctly or has used it contrary to the instructions for use and/or safety regulations.
2) Park & Bike The Hague is not responsible and/or liable for bicycle accidents or dangerous situations and accidents.
3) Park & Bike The Hagueg is not liable for any damage, such as bodily injury, death, property damage or damage to third parties during the use of the bicycle. The use of the bicycle is entirely at your own risk.
4) Park & Bike The Hague cannot be held responsible for fines during the use of the bicycle received by the hirer.
5) We disclaim all liability, in any capacity and for any reason, for any damage arising in particular from accidents, theft or damage that may occur on the premises of Park & Bike The Hague to your car.
6) The service we provide includes only the provision of a parking space and a rental bike with a coaster brake or with hand brakes and three gears. Supervision is provided during office hours. Since we do not act in the capacity of a legal custodian, we do not assume any obligation to supervise and are in no way liable for the actions of uninvolved parties.

Article 10. Refund

Business group rental

  • Changes can be made at least 48 hours in advance.
  • Cancellations can be made at least 48 hours in advance without charge.
  • On the day, we will not issue a refund and will charge half of the rent.
  • Bicycles that are delivered and have not been used will be invoiced for the time being. Unfortunately, we do not grant any refunds for this.
  • The above conditions also apply in case of bad weather.
  • Cancellations and/or changes must be submitted by mail. 

Private rental

  • Changes are free of charge.
  • For cancellations on the day itself, we unfortunately do not grant refunds.
  • For cancellations at least 24 hours in advance, we grant a 50% refund minus a € 4,50 administration fee. This amount will be refunded within 48 hours.
  • For cancellations at least 48 hours in advance, we will grant a refund minus a € 4.50 administration fee. This amount will be refunded within 48 hours.
  • We do not issue refunds if you return your bike earlier than the end date of the rental period.
  • The above conditions also apply in case of bad weather.
  • Cancellations and/or changes must be submitted by mail.

Article 11. Personal data and processing
Park & Bike Den Haag processes personal data in order to offer its services via the website and for the purposes specified in the general conditions. The personal data is required to be able to use the services. Our privacy policy can be found on our website www.parkenbikedenhaag.nl.

Article 12. Amendment provision
If one or more of the provisions of these General Terms and Conditions are void or are nullified, the remaining provisions of these General Terms and Conditions will continue to apply in full. The Landlord and the Tenant will then consult to agree on new provisions to replace the void or annulled provisions, taking into account, if and as far as possible, the object and purport of the original provision.

Article 13. Dispute Resolution
1) Disputes between the lessee and Park & Bike Den Haag concerning the conclusion or execution of agreements relating to services and goods to be provided or delivered by the lessor in this regard shall as far as possible be resolved amicably.
2) If the lessee and Park & Bike Den Haag do not reach an amicable solution within four months, only the court is authorized to take cognizance of the dispute.

Article 14. Applicable law
1) All rental agreements between Park & Bike Den Haag, the tenant and the present general conditions are governed exclusively by Dutch law.
2) Any disputes shall be submitted exclusively to the competent judge of the District Court of The Hague.
